What
is the value of my case?
The
most frequent question our clients ask is, "How
much money will I receive from my case?" Placing
a value on a personal injury case is not easy, but there
are three simple tips to consider.
First, cases are generally valued based on the extent
of the damages. The greater the damages, the greater
the value of the case. For example, a person who suffers
a broken bone or other serious injury may be entitled
to more damages than a person who simply has a "soft
tissue" injury.
Second, the strength of the case in terms of liability
is also important (i.e., how did the incident occur?).
A medical malpractice case where a physician leaves
a sponge in a patient may be easier to prove than a
different type of case. Accordingly, the stronger case
may be more likely to be successfully resolved.
Third, there are many other damages that are to be considered
when valuing a claim. These may include (but are not
necessarily limited to) the following:
- lost
wages
- pain
and suffering
- emotional
distress
- scarring
- disfigurement
- medical
bills
