During
the past three decades almost eighty million people
have taken cruise vacations. The cruise industry is
the fastest growing segment of the vacation market,
and industry leaders plan on constructing over fifty
new ships in the coming five years. Simply put, the
cruise industry is booming. Combined, the major cruise
lines make billions of dollars annually. In spite of
this success many cruise lines have recently come under
fire for poor shipboard safety and sanitation practices.
Some lines have even admitted to dumping polluted sewage
into the very oceans their ships ply. Carnival Cruise
Lines experienced several high profile incidents recently
including fires aboard the Tropicale and the Ecstasy
and allegations of criminal activity (ranging from petty
theft to sexual assault) aboard Carnival ships.
Unfortunately, cruise lines have become quite efficient
at limiting their liability for these types of incidents
through the use of fine print found on passengers' tickets.
One of the most effective techniques used by the industry
to limit personal injury litigation is to require that
all lawsuits be filed in the port of embarkation. The
cruise lines are well aware that most of their passengers
do not live near these ports or probably even in the
same state. As a result, many otherwise valid lawsuits
are never pursued because of the victim's reluctance
to travel back to the area for trial.
Common shipboard accidents and injuries include:
- injuries
caused by shipboard emergencies (fire, collisions,
abandonment)
- assault
by crew members or fellow passengers
- injuries
sustained while participating in planned activities
either aboard ship or during shore excursions
- food
borne illnesses
- slip-and-fall
- sexual
battery (rape) by crew members or fellow passengers
